Clause Seven: Dedicated Servers
Dedicated Servers Definition: Dedicated servers, including VPS and VDS, are a type of server provided to the customer. The usage agreement policy for dedicated servers differs from shared hosting, as configuring these servers requires slightly longer setup times than shared hosting, as well as for temporary suspension and termination policies.
Provisioning: The product or service is provided to the customer within 1 to 48 hours maximum from the start of invoice payment (during working hours). An email is sent to the customer to inform them of their request processing and server setup based on the customer's requested configuration at the time of product or service request.
Setup Notification: An email is sent to the customer upon server setup, containing all the details related to the requested product or service. The customer can control and manage the server through their dedicated control panel provided by Linkysoft.
Grace Period: The service or product invoice is issued at least 10 days before the renewal date, and the customer is required to pay the server subscription fee at least 7 days before the renewal date. If the invoice is not paid before the renewal date, a 3-day grace period is granted.
Temporary Suspension Period: If the grace period ends, the service or product is suspended, and the customer cannot access it until the invoice is paid. The temporary suspension period lasts for 4 days from the end of the grace period. During this period, the customer cannot use their product, but they can request access to their product data and database data for a maximum of 48 hours of free operation, with additional fees applicable based on the data size.
Service or Product Termination: Upon the expiry of the grace period and the temporary suspension period for dedicated servers, the service is terminated automatically, and all files, databases, and backups are deleted. The customer cannot retrieve their data or any files or emails on dedicated hosting services.
Termination Request and Backup Retention: The customer has the right to request the permanent termination of the service or product with the condition of retaining a backup copy of the product or service files and databases. A fee is charged for backup retention, calculated monthly at 50% of the product value. The customer can request backup retention at any time without restrictions.
Refund Policy: All dedicated servers for services are fully managed by Linkysoft, according to the customer's choice. Full management means configuring the server for the customer based on the chosen operating system and product or service. Linkysoft does not provide licenses for illegal applications or operating systems. In such cases, the responsibility for the server lies with the customer, who manages the server independently. The customer has the right to access the root and manage all server functions if desired.
All dedicated servers for products are fully managed by Linkysoft and not managed by the customer. Full management means configuring the server for the customer based on the chosen operating system and product. In this case, full responsibility for the server lies with Linkysoft, and server management is done by Linkysoft employees. Linkysoft remains responsible for updating, repairing, and continuously monitoring the server. The customer cannot access the root or manage the server beyond the available permissions for product management.
The customer has the right to request cancellation of the server at any time before the renewal date. If the customer wishes to obtain a backup copy of the files and databases, they must request cancellation of the server at least 10 days before the renewal date. Additional fees may apply if a backup copy is taken by Linkysoft, determined based on the data size.
The customer has the right to request a refund and cancel the service within 45 days from the start date of the service if the customer has chosen quarterly, semi-annual, or annual payment plans. This period is intended to provide sufficient time for the customer to try the service and ensure their satisfaction. Conversely, the customer is not entitled to request a refund if they choose the monthly payment plan, as this plan is considered short-term and assumes the customer's commitment to trying the service for a limited period.
Discounts and Fees:
The customer bears the installation fees of the server, if applicable, in addition to the money transfer fees. These fees are necessary to cover the costs of setup and banking procedures associated with the refund process. These costs are detailed in advance in the service terms to ensure the best experience for customers who choose long-term payment plans.
How to Submit a Refund Request:
To ensure efficient and effective processing of the refund request, the customer must submit the request by contacting us via [contact details / email / form available on the website], mentioning the invoice number and the service details required for cancellation. After receiving the request, it will be processed within 10 working days, ensuring a prompt response and smooth completion of the process. Please note that the refund amount will be returned to the same payment method used by the customer at the time of purchase, ensuring the ease and security of the transaction.
