Terms of Service — Linkysoft

1. Who is teaming up?

These Terms of Service (let's just call them our “Terms”) are all about the awesome relationship between Linkysoft (“Linkysoft”, “we”, “us”) and you, or the amazing company you represent (“you”, “the client”).

Linkysoft is a super creative software company! We build amazing websites, cool web and mobile apps, smart AI systems, and rock-solid security solutions for people and businesses everywhere. We also handle the behind-the-scenes tech to keep it all running perfectly. We have awesome teams in Egypt, the UK, and all over the globe!

You agree to these Terms when you do any of these fun things: approve a project plan, pay an invoice, or start using the amazing system we built for you. If you're doing this for your company, you're telling us you have the superpower to agree for them!

Most of the super specific details for your project will be in a separate, signed plan. If anything in that plan is different from these Terms, the signed plan is the boss for that specific project! These Terms just cover all the usual stuff.

2. Fun words we use a lot

To keep things short and sweet, here is a quick guide to some words you'll see often!

Services: All the awesome design, coding, security, AI, and tech work we do just for you!
Project: A specific, exciting mission we're working on together, detailed in our plan.
Statement of Work (SOW): The super important document that outlines our mission, what we're building, the timeline, and the cost.
Deliverables: The amazing things we hand over to you — like designs, code, guides, and fully working systems!
Infrastructure: The behind-the-scenes tech we set up and run so your project works perfectly (see section 5).
Source Code: The secret recipe (the actual code) we write to make your project work. Our Source Code agreement tells you if you get to keep it!
Your Content: All the cool text, pictures, data, and logos you give us to make your project shine!

3. How we rock projects together

Every great adventure starts with understanding the goal! We love learning about your business and figuring out exactly what you need. Then, we write up a fun and clear plan (the SOW) with all the details, timelines, and costs. Once we both give it a thumbs up, the fun begins!

Changing the plan

Our plan tells us exactly what we're building. If you get a brilliant idea for something new later on — like a cool new feature — that's awesome! We'll figure out how much time it takes and tell you the cost. We won't ever do extra work or charge you more without your enthusiastic "Yes!" first.

Our exciting timelines

The dates in our plan are our best estimates, and they depend on you sending us your cool content, feedback, and approvals on time! If things get delayed on your end, our timeline will just bump back a bit. We'll always keep you in the loop if we're waiting on something to keep the momentum going!

Reviewing our awesome work

When we finish a big piece of the project, you get a special time (written in our plan, usually a few days) to play with it and tell us what you think! We'll gladly fix anything that doesn't perfectly match our agreed plan. The work is totally accepted when you say you love it, when the review time is up, or when you start using it for real!

Helpful outside tools

Building modern software means using awesome, ready-made tools and services created by others. We only pick the best and most reliable ones! Just so you know, these tools come with their own set of rules, which are separate from ours.

4. All the awesome things we do

We offer tons of amazing services! These general rules apply to all of them, and we've added some fun specific details below.

Website Design & Development

We design and build breathtaking websites for everyone! Unless our plan says otherwise, we make sure they look stunning on all modern browsers, work perfectly on phones, and are super fast and accessible. The exact number of pages and cool features will be right there in our plan!

Custom Web Applications

We build super smart, custom online systems just for your business — like awesome dashboards and portals! Because these are built perfectly for your unique needs, the master plan we agree on is our ultimate guide for knowing when the project is complete.

Mobile App Development

We build incredible apps for phones and tablets! If your app goes to the Apple App Store or Google Play, you'll need to set up your own developer accounts and follow their rules. We'll happily help you get everything ready and submitted! Just remember, how fast they approve it is up to them.

Cybersecurity

We are super serious about keeping things safe! We offer amazing security checks and testing to protect your systems. We only ever test things you own and give us strict permission to test. While we do an amazing job finding risks, no system can ever be 100% perfect forever, so this isn't a guaranteed shield against future surprises!

AI Systems

We build brilliant AI features that make life easier, and we love having a human check things over! AI can do amazing things, but it can sometimes make silly mistakes or be a bit biased based on what it learned. We build them to be carefully reviewed, so we can't promise every single AI answer is absolutely perfect. It's always up to you how you use the cool AI results in your business!

Website Protection & Monitoring

We offer awesome services to watch over your website and step in if there's a hiccup! We do this based on our plan and SLA. We work incredibly hard to keep everything running beautifully, but think of it like a really great safety net, rather than a guarantee that nothing will ever go offline.

UI/UX Design

We design beautiful, easy-to-use experiences that people love! All the fun things we deliver — like research, mockups, and final stunning designs — will be listed in our plan. The plan also tells us how many rounds of tweaks we get to do; if you want more after that, we can easily add it to the plan!

API Integration

We love connecting your systems to other awesome services! Sometimes those other services change how they work or what they charge. If they change something that breaks our connection, fixing it will be a fun new mini-project, unless our support plan already covers it!

5. The tech behind the scenes

Everything we build needs a wonderful place to live on the internet! Here is how we handle that part with ease.

Just a quick note: Linkysoft isn't a hosting company. We don't sell servers or website names on their own, and you won't find any hosting prices on our site!

What we do is way better: when your project needs a home on the internet, we set up, secure, and run the perfect servers and domains just for you! It's all part of the complete package we build. This usually means a dedicated, super-fast server and your amazing website names, all managed by us so everything works together beautifully!

The cost for this awesome tech setup is included right in your project's plan. It's never a surprise extra hosting fee!

Who owns the cool stuff

Your website names (domains) are always registered in your name — your brand is totally yours! As for the servers, our plan will clearly say if you take them over, if we keep running them for you, or if we turn them off when the project is wonderfully finished.

Keeping the lights on

While we're running things for you, we handle all the important stuff like security updates, taking safe backups, and watching over the system's health! All the details on how often we back things up and how fast we respond are right in our plan and SLA.

When it's time to hand over

When our amazing project comes to a close, we'll happily help you move things, give you all the keys, or gracefully turn the tech off — whatever our plan says! We will never hold your website names or data hostage. As long as everything is paid up, you get a super clean and happy handover!

6. Pricing and happy payments

The exact price for your awesome project will be right there in our plan! We don't have standard price lists because every project is a unique and exciting adventure! We might agree on a fixed price, charge for the exact time we spend, or set up a regular monthly plan.

Please pay our invoices within the super reasonable time we agree on (it's on the invoice or in our plan). Big, exciting projects are usually paid in stages, starting with a happy deposit before we dive in!
Our prices don't include taxes. If taxes apply, they'll be clearly added to the invoice, and you'll need to cover them.
If we have to buy something special just for you — like a cool software license or a domain name — we just pass that exact cost on to you, exactly as our plan says!
If a payment gets super delayed, we might have to pause our exciting work until things are settled. Don't worry, we will always give you a friendly heads-up before anything stops!

7. How you can help us be amazing

Projects speed along when we work as a great team! To keep things incredibly fast and fun, we need you to:

Happily provide the content, access, and approvals we need, right on time!
Make absolutely sure you own (or have the right to use) all the pictures, text, and data you give us — so we don't accidentally step on anyone's toes!
Pick one awesome person on your team to answer questions and say "Yes!", so we don't get stuck waiting for a big group to decide.
Keep your passwords super safe, and let us know right away if you think someone sneaked into your account.
Use the wonderful things we build in a good and legal way, following our Acceptable Use Policy.
Always keep your own safe copies of your important data, just in case, even though we run awesome backups too!

If we're ever waiting on something from you, we'll send a friendly reminder! We can't be responsible for delays if we're missing the pieces we need from you to do our best work.

8. Who owns all this cool stuff?

Anything you owned before we started — like your amazing brand and pictures — is always yours! And anything we owned — like our special tools and tricks — stays ours.

For the brand new things we create just for you, ownership becomes yours as soon as the final payment is beautifully settled! Sometimes this includes the secret recipe (the source code), and sometimes you just get a license to use it. We always agree on this right at the start, so there are never any surprises!

We do keep the clever, reusable building blocks we use to make things fast and awesome. Using them for your project doesn't mean we can't use our clever tricks again for someone else!

We love bragging about the incredible work we do together! We might show it off in our portfolio, but we'll always hide your specific details and respect any secrets we promised to keep. If you prefer we stay totally quiet about it, just let us know and we'll happily zip our lips!

9. Our amazing promises to you

We promise to do a fantastic, professional job and use all our amazing skills! If something we deliver doesn't perfectly match our agreed plan, just tell us within the time we agreed on, and we will absolutely fix it with a smile!

Other than those promises, everything is provided just "as is". Tech is super complicated, so we can't promise there will never ever be a tiny bug, or that things will run flawlessly forever without a single hiccup. As much as the law allows, we skip all those extra implied legal promises.

Two super honest things to remember: no security is 100% perfect forever, and AI answers should always be double-checked. Both are incredibly helpful and amazing, but they aren't guaranteed to be flawless!

10. Keeping things safe and fair

As much as the law allows, neither of us is responsible to the other for indirect, special, or accidental losses — like lost profits or lost data — even if we knew it might happen.

If something does go wrong, our total responsibility for the whole project is capped at the total amount you delightfully paid us for that specific project in the last year.

Of course, this doesn't limit responsibility for incredibly serious things that the law says we can't ignore — like if someone gets really hurt because of a terrible mistake, or for fraud.

11. Keeping your secrets super safe

Working together means sharing cool, top-secret stuff! We both promise to keep each other's secrets completely safe, only use them for our awesome project, and protect them really well. We are always happy to sign a special agreement to keep things totally hush-hush!

Whenever we handle people's personal details for you, we treat them with incredible care, following our Privacy Policy and Data Processing Agreement.

12. How long our adventure lasts

These fun terms apply the whole time we are happily working together or while you use the awesome systems we run! A specific project lasts until it's wonderfully finished or our plan officially ends.

Either of us can nicely end a project by giving the notice we agreed on. Also, either of us can stop things quickly if the other person seriously breaks these rules and doesn't happily fix it when asked.

If our adventure ends, you just pay for the great work we've done so far, we hand over everything you paid for, and we happily help you move or turn off the tech! We can also pause things if payments stop or if rules are seriously broken — but we'll almost always give you a friendly warning first!

13. Updating these fun rules

We might update these Terms sometimes as we grow and learn! If we make a big change, we'll update the date at the top and let our active clients know. If you keep happily working with us after that, it means you love the new rules too!

Don't worry, the specific prices and plans we already signed won't change just because these Terms do! Those stay exactly as we happily agreed, unless we both decide to change them.

14. Solving hiccups together

Our signed plan will tell us which country's rules we follow if things get complicated. If the plan doesn't say, we just follow the rules of the Linkysoft office you teamed up with!

If a tiny hiccup happens, let's just talk about it! Almost everything can be fixed with a friendly chat and a smile. We both promise to try our absolute best to solve things happily before getting any legal folks involved. But of course, anyone can ask a court for help in a true emergency!
